HBA-CCH H.B. 1760 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1760 By: Turner, Sylvester Business & Industry 3/15/2001 Introduced BACKGROUND AND PURPOSE Tenants and government officials may need the business phone number of the landlord or manager of a residential housing complex. Currently, landlords and managers are only required to disclose their name and address. House Bill 1760 requires the disclosure of a landlord's and management company's phone number to a tenant or government official. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1760 amends the Property Code to require a landlord of a residential rental property to disclose to a tenant, or to any government official or employee acting in an official capacity, the phone number of the holder of the record title of a tenant's residence and of the management company. The bill provides that a landlord is responsible for correcting the change of a phone number, and that the landlord acts in bad faith and is liable for providing an incorrect phone number. EFFECTIVE DATE September 1, 2001.
