BACKGROUND AND PURPOSE 

Prior to the 77th Legislature, a retired judge, a senior judge, a
legislator or retired legislator, or the attorney general (officials) could
not administer an oath.  Since these officials represent the people of
Texas, they should be allowed to administer oaths.  House Bill 1766
provides that an oath made in this state may be administered and a
certificate of the fact given by these officials. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 1766 amends the Government Code to provide that an oath made in
this state may be administered and a certificate of the fact given by a
retired judge, a senior judge, a legislator or retired legislator, or the
attorney general. 

EFFECTIVE DATE

September 1, 2001.
