HBA-CBW H.B. 1766 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1766 By: Turner, Bob Judicial Affairs 4/4/2001 Introduced BACKGROUND AND PURPOSE Current law does not authorize a retired judge or senior judge to administer an oath or give a certificate of the fact. These judges are capable professionals and should be allowed to administer oaths. House Bill 1766 allows an oath to be made or a certificate of the fact to be given by a retired judge or senior judge. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1766 amends the Government Code to provide that an oath made in this state may also be administered and a certificate of the fact given by a retired judge or senior judge. EFFECTIVE DATE September 1, 2001.
