HBA-JEK H.B. 1835 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1835 By: Shields Corrections 3/18/2001 Introduced BACKGROUND AND PURPOSE The University of Texas Medical Branch at Galveston and Texas Tech University Health Sciences Center provide health care for inmates in the institutional division of the Texas Department of Criminal Justice (TDCJ). While the Correctional Managed Health Care Committee (CMHCC) oversees medical care for inmates and investigates medical grievances, providers are not obligated to act on these grievances. House Bill 1835 requires a medical care provider to respond to a medical grievance inquiry referred by TDCJ or CMHCC no later than the 20th date after the grievance is referred to the provider. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1835 amends the Government Code to require a medical care provider to respond to a medical grievance inquiry referred by the Texas Department of Criminal Justice or the Correctional Managed Health Care Committee no later than the 20th day after the date the grievance is referred. EFFECTIVE DATE September 1, 2001.
