HBA-BSM H.B. 1935 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1935 By: Deshotel Judicial Affairs 3/13/2001 Introduced BACKGROUND AND PURPOSE Previous legislation replaced the scaled-fee schedule, used for the collection of certain fees in the probate courts with a flat-fee schedule. Although the new system has been efficient, it has not been able to generate the revenue the scaled-fee schedule achieved. Therefore, new filing fees are needed to recoup money lost from the change in fee systems. House Bill 1935 raises certain filing fees collected by a county clerk. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1935 amends the Local Government Code to require each clerk of a county court to collect a $10.00 fee for filing a document not already listed, and increase the issuing fee for an original document and one copy from $4.00 to $8.00. EFFECTIVE DATE September 1, 2001.
