HBA-MPM H.B. 201 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 201 By: Seaman Public Education 3/5/2001 Introduced BACKGROUND AND PURPOSE State law requires school districts to provide a copy of employment policies to each teacher and a copy of state provisions regarding alternative settings for behavior management to teachers and administrators. These requirements may burden some school districts with the cost of providing copies. House Bill 201 requires the board of trustees to provide copies of the information only upon request. Additionally, the bill requires the placement of this information on the school district's website, if a district website exists. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 201 amends the Education Code to require the board of trustees of a school district to provide a copy of the board's employment policies only upon request of a teacher. The bill requires the board to make a copy of the employment policies available at each school district for inspection at a reasonable time, and if the district has its own website, to post the district's employment policies on the Internet. The bill also modifies the requirement that a school district provide teachers and administrators with a copy of state law pertaining to alternative settings for behavior management to require districts to provide a copy only on the request of a teacher or an administrator. The bill also requires school districts to post a copy of the law on its Internet website, if it has one. EFFECTIVE DATE On passage or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. The Act applies beginning with the 2001-2002 school year.
