HBA-DMH H.B. 2037 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2037 By: Haggerty Licensing & Administrative Procedures 3/2/2001 Introduced BACKGROUND AND PURPOSE Currently, specified permit holders must obtain a local cartage permit to transfer or transport alcoholic beverages to customers or to and from the permit holder's other licensed premises. House Bill 2037 enables specified permit holders to transfer or transport alcoholic beverages without requiring such permit holders to obtain a local cartage permit if the permittees conform to certain transportation and vehicle designation requirements. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2037 amends the Alcoholic Beverage Code to repeal provisions relating to local cartage permit requirements. The bill requires that a vehicle used by the holder of a package store permit, wine only package store permit, or local distributor's permit for the transportation of alcoholic beverages be made available for inspection by Texas Alcoholic Beverage Commission (commission) personnel on request. The bill requires that specified vehicles used by such permit holders for the transportation of alcoholic beverages be designated on the exterior of the vehicle as required by the commission. The bill prohibits the holder of a package store permit from transporting liquor for hire. EFFECTIVE DATE September 1, 2001.
