HBA-BSM, EDN H.B. 2090 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2090 By: Salinas Criminal Jurisprudence 3/29/2001 Introduced BACKGROUND AND PURPOSE Traps and snares are set to catch animals such as coyotes and bobcats because they are perceived as pests. However, sometimes animals not intended for the traps are caught and are restrained until the trapper removes the animal, although in some cases the animal has already perished. Current law exempts the inhumane treatment of wild animals that have been trapped in this manner. House Bill 2090 amends law relating to cruelty to animals to include animals that have been trapped or captured. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2090 amends the Penal Code to provide that in relation to an offense of cruelty to animals the definition of "animal" includes a wild living creature whose capture was accomplished by conduct constituting such an offense. EFFECTIVE DATE September 1, 2001.
