HBA-BSM H.B. 2093 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2093 By: Brown, Betty Natural Resources 4/12/2001 Introduced BACKGROUND AND PURPOSE The Texas Natural Resource Conservation Commission (TNRCC) is responsible for establishing and enforcing regulations of on-site sewage systems. These regulations are relatively broad to ensure coverage of all of Texas. As a result, the regulations are adequate for some counties, but not necessarily for other counties. Under current law, local governmental entities must meet TNRCC's minimum requirement for on-site sewage systems and an authorized agent must obtain TNRCC approval of any substantive amendments to the agent's order or resolution. House Bill 2093 provides that a local governmental entity may exceed the commission's minimum requirements and provides that an authorized agent must file with TNRCC any substantive amendments to the agent's order or resolution. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2093 amends the Health and Safety Code to provide that a local governmental entity's order or resolution adopting standards for on-site sewage disposal systems must meet or exceed the minimum requirements set by the Texas Natural Resource Conservation Commission (TNRCC). The bill also provides that an authorized agent must file with TNRCC any substantive amendments to the agent's order or resolution. EFFECTIVE DATE September 1, 2001.
