HBA-KDB H.B. 2164 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2164 By: Goolsby House Administration 7/20/2001 Enrolled BACKGROUND AND PURPOSE The property known as Woodlawn was purchased from The University of Texas System by the General Services Commission, which in turn deeded the property to the State Preservation Board (board). However, prior to the 77th Legislature, the board did not have the authority to dispose of the property. House Bill 2164 authorizes the board to sell Woodlawn at its fair market value and requires the proceeds from the transaction to be deposited in the capitol renewal account or its successor. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2164 amends the Government Code to authorize the State Preservation Board (board), after consulting with the Texas Historical Commission and with the approval of the Legislative Budget Board, to sell Woodlawn at its fair market value. The bill requires the General Land Office to transact the sale on behalf of the board using procedures for real estate transactions authorized by the legislature. The bill requires proceeds from the transaction to be deposited in the capitol renewal account or its successor and authorizes proceeds from the transaction to be spent only for maintaining and preserving the Capitol, the General Land Office Building, their contents, and their grounds. EFFECTIVE DATE June 15, 2001.
