HBA-JEK H.B. 2205 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2205 By: Gutierrez Public Education 3/26/2001 Introduced BACKGROUND AND PURPOSE A 17-year-old student who commits an offense for which the student is expelled is not under the jurisdiction of the juvenile court, which means that the student is not required to attend the Juvenile Justice Alternative Education Program (JJAEP). However, compulsory school attendance applies to a student until the student is 18 years of age. House Bill 2205 resolves this apparent discrepancy by requiring expelled students to attend a JJAEP until the end of the term of expulsion or until the date the student is no longer required to attend school. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2205 amends the Education Code to require students who are expelled from school for certain offenses to attend the juvenile justice alternative education program in the county in which the student resides until the student is no longer required to attend school or until the end of the term of expulsion, whichever is earlier. This requirement applies to a student who is required to attend school, is expelled for a specified serious offense, and is not under the jurisdiction of a juvenile court. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. This Act applies beginning with the 2001-2002 school year.
