HBA-JEK C.S.H.B. 2360 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 2360 By: Isett State, Federal & International Relations 4/23/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Monuments and memorials that honor Texans for their military service serve as a reminder of the sacrifices and contributions that have been made by the men and women of this state. Many of the monuments and memorials that honor veterans are located on state property. C.S.H.B. 2360 authorizes the removal, relocation, or alteration of certain monuments and memorials located on state property, only by certain agencies with the intent to repair or improve or to relocate it to a prominent location. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 2360 amends the Government Code to authorize the removal, relocation, or alteration of a permanent monument or memorial only by the legislature, the Texas Historical Commission, the State Preservation Board, or to accommodate the construction, repair, or improvement of the permanent monument, memorial, or the surrounding state property. The bill provides that any permanent monument or memorial that is permanently removed must be relocated to a prominent location determined by the legislature. EFFECTIVE DATE September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 2360 differs from the original bill by modifying the definition of "monument or memorial" to specify that a monument means a permanent monument. The substitute removes the reference in the original that included a flag in the definition of "monument or memorial." The substitute also provides that the relocation of a monument or memorial must be to a prominent location. The original bill specified that the relocation must be at an equally prominent location.
