HBA-EDN H.B. 2461 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2461 By: Ellis, Dan Environmental Regulation 3/26/2001 Introduced BACKGROUND AND PURPOSE Under current law, residents of a residential subdivision may only burn greenwaste from their own land and are unable to consolidate greenwaste for on-site burning at one location within the subdivision. Consolidating greenwaste and disposing of it in one fire, rather than in several individual fires throughout the subdivision, may be a safer practice. House Bill 2461 authorizes residents of a subdivision to consolidate their greenwaste to be burned at one location within the subdivision. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Natural Resource Conservation Commission in SECTION 1 (Sec. 382.018) of this bill. ANALYSIS House Bill 2461 amends the Health and Safety Code to require the Texas Natural Resource Conservation Commission, by rule, to authorize residents of a residential subdivision to consolidate for on-site burning at one location within the subdivision and to burn at that location waste from individual residents' properties that consists of trees, brush, and other plant growth. EFFECTIVE DATE September 1, 2001.
