HBA-BSM H.B. 2562 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2562 By: Dunnam Judicial Affairs 4/4/2001 Introduced BACKGROUND AND PURPOSE Currently, the Texas Supreme Court is authorized to make rule changes at any time. New rules as determined by the Supreme Court become effective not earlier than 60 days following publication. House Bill 2562 changes the time frame in which the supreme court may promulgate rules to the first 95 days of the regular session of the legislature. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2562 amends the Government Code to authorize the supreme court to promulgate a specific rule or rules of civil procedure or an amendment or amendments to a specific rule or rules only during the first 95 days of a regular session of the legislature. The rule or rules become effective unless disapproved by a joint resolution of the legislature adopted during the regular session on September 1 following the regular session. At the time a rule becomes effective the court is required to file with the secretary of state a list of each article or section of general law or each part of an article or section of general law that in the court's judgment is repealed. EFFECTIVE DATE September 1, 2001.
