HBA-CMT H.B. 2747 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2747 By: Davis, John Transportation 3/22/2001 Introduced BACKGROUND AND PURPOSE Each navigation district is allowed to set aside five percent of its revenue each calendar year in a promotion and development fund to fund any expense to promote and develop business for the port or waterway operated by the district. Currently, a county auditor is prohibited from auditing disbursements from the promotion and development fund of a navigation district. House Bill 2747 authorizes a county auditor to audit disbursements from a navigation district's promotion and development fund. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2747 amends the Water Code to authorize, rather than prohibit, a county auditor to audit disbursements from the promotion and development fund of a navigation district. EFFECTIVE DATE On passage, or if the act does not receive the necessary vote, the Act takes effect September 1, 2001.
