BACKGROUND AND PURPOSE 

Currently, the United States Army Corps of Engineers deposits beach-quality
sand dredged in constructing and maintaining navigational inlets and
channels of the state on eroding beaches.  This activity can provide
nourishment for beaches, contribute to the  development of wetland
habitats, and  save the public money. House Bill 2794 requires the
commissioner of the General Land Office to adopt rules regarding the
placement of beach-quality sand on eroding beaches adjacent to where the
sand is being dredged. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that rulemaking
authority is expressly delegated to the commissioner of the General Land
Office in SECTION 1 (Sec. 33.602, Natural Resources Code) of this bill. 

ANALYSIS

House Bill 2794 amends the Natural Resource Code to require the
commissioner of the General Land Office to adopt rules requiring that
beach-quality sand dredged in constructing and maintaining navigation
inlets and channels of the state be placed on eroding beaches adjacent to
the navigation inlets and channels wherever practicable. 

EFFECTIVE DATE

September 1, 2001.
