BACKGROUND AND PURPOSE 

The Dallas/Fort Worth airport which is owned by the cities of Fort Worth
and Dallas is located in the City of Grapevine and other surrounding cities
which do not provide police or city services for maintenance and public
safety at the airport.  However, these host cities receive millions of
dollars in revenue generated by traffic citations issued at the airport.
House Bill 2917 requires certain municipal courts to have within the
boundaries of an airport under a joint board concurrent jurisdiction with
the justice court of the precinct and each other municipal court located in
the municipality in certain criminal cases arising under state law that
regulates traffic. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2917 amends the Code of Criminal Procedure and the Government
Code to require a municipal court, including a municipal court of record,
that is located in a populous home-rule municipality that is a constituent
agency on a joint board to have within the boundaries of the airport that
is governed by the joint board concurrent jurisdiction with the justice
court of the precinct in which the municipality is located in each criminal
case arising under state law that regulates traffic and is punishable by a
fine or another sanction that does not consist of confinement.  The bill
also requires that the municipal court have within the boundaries of the
airport that is governed by the joint board concurrent jurisdiction with
each other municipal court located in the municipality in each criminal
case arising under a resolution, rule, or order of the joint board of which
the municipality is a constituent agency that regulates traffic and is
punishable by a fine not to exceed $500. 

EFFECTIVE DATE

September 1, 2001.
