HBA-MPM H.B. 2939 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2939 By: Capelo Public Safety 4/6/2001 Introduced BACKGROUND AND PURPOSE In the last few years, several vehicle tire models have been recalled because of defects. Even after a tire has been recalled, consumers with a defective tire might continue to use it on a vehicle, putting themselves and other drivers at risk. For example, in October 2000, United States regulators announced that the death count associated with Bridgestone/Firestone tires subject to recall was 119. A statutory requirement is necessary to ensure that people replace defective tires in a timely manner. House Bill 2939 prohibits a vehicle inspector from issuing a safety inspection sticker for any vehicle equipped with recalled tires. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2939 amends the Transportation Code to prohibit an inspection station or inspector from issuing an inspection certificate for a vehicle equipped with a tire subject to a voluntary or involuntary recall by a manufacturer or governmental entity. EFFECTIVE DATE September 1, 2001.
