HBA-CBW H.B. 3063 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3063 By: Brown, Fred Juvenile Justice & Family Issues 4/1/2001 Introduced BACKGROUND AND PURPOSE Under current law, court records regarding an adoption are confidential, and no person is entitled to access to or information from these records, unless an order is entered by the court that granted the adoption or terminated the proceedings. This may cause an undue burden on many adoptees attempting to access their records or information because they must travel to the court that granted the adoption or terminated the proceedings to access the records. House Bill 3063 entitles a court, rather than the court that granted the adoption or terminated the proceedings, to access to or information from certain records regarding an adoption. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3063 amends the Family Code to entitle a court, rather than the court that granted the adoption or terminated the proceedings, to access to or information from certain records relating to adoption. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
