HBA-JEK H.B. 3081 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3081 By: Burnam Business & Industry 4/1/2001 Introduced BACKGROUND AND PURPOSE Current law provides that an entity that stores, repairs, or performs maintenance work on an aircraft has a lien on the aircraft for the amount specified in the contract or the amount reasonably charged for those services. However, current law does not extend this authority to an aircraft fuel vendor. House Bill 3081 enables an aircraft fuel vendor to hold a lien on the aircraft for the amount charged for the fuel. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3081 amends the Property Code to provide that a person who fuels an aircraft has a lien on the aircraft for the amount due under a contract or, if there is no amount specified in the contract, reasonable and usual compensation for the fuel. EFFECTIVE DATE September 1, 2001.
