HBA-LJP H.B. 3094 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3094 By: Janek Juvenile Justice & Family Issues 3/26/2001 Introduced BACKGROUND AND PURPOSE Under current law, a court is required to specify in a standard possession order that a possessory conservator has the right of possession of a child for the summer if the possessory conservator gives the managing conservator notice of the extended period or periods of summer possession by April 1 of each year. Managing conservators who work outside the home must often make summer vacation arrangements with day-care centers or summer camps before the 1st of April. House Bill 3094 provides for a court to specify in a standard possession order that the possessory conservator give a managing conservator who is employed outside of the home notice of summer possession by March 1 of each year and by April 1 of each year if the managing conservator is not employed outside of the home. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3094 amends the Family Code relating to the standard possession order providing for possession of or access to a child. The bill requires the court to specify in a standard possession order that a possessory conservator give the managing conservator written notice of the extended period or periods of summer possession by March 1 of each year, if the managing conservator is employed outside the home at the time the notice is given. If the managing conservator is not employed outside the home, then the court is required to specify in a standard possession order that the possessory conservator give the managing conservator the written notice of the period of summer possession by April 1 of each year. EFFECTIVE DATE September 1, 2001.
