HBA-CCH H.B. 3112 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3112 By: Ritter Public Education 3/26/2001 Introduced BACKGROUND AND PURPOSE Current law requires each school district to adopt a student code of conduct, but does not set a minimum standard for the code. House Bill 3112 requires the Texas Education Agency to adopt minimum standards for the conduct of public school students in Texas and minimum consequences for violating those standards. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3112 amends the Education Code to require the Texas Education Agency to adopt, no later than May 1, 2002, a student code of conduct that prescribes minimum standards for the conduct of public school students in Texas and minimum consequences for a violation of those standards. The bill provides that a district's student code of conduct must be consistent with and at least as stringent as the minimum student code of conduct beginning with the 2002-2003 school year. EFFECTIVE DATE September 1, 2001.
