HBA-DMH H.B. 3288 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3288 By: Madden Licensing & Administrative Procedures 3/28/2001 Introduced BACKGROUND AND PURPOSE Some areas have held local option elections to elect to permit or prohibit the sale of certain alcoholic beverages. A city located in two counties is prevented from conducting a local option election regarding the sale of beer and wine. House Bill 3288 provides that an incorporated city or town located in two counties that meets certain population requirements may hold an election to permit or prohibit the legal sale of beer and wine. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3288 amends the Alcoholic Beverage Code to include the option for a local election to permit or prohibit the legal sale of beer and wine in an incorporated city or town where all or a portion of the incorporated city or town does not permit beer and wine sales on September 1, 2001, is located in two counties that meets specified population requirements. EFFECTIVE DATE September 1, 2001.
