HBA-CBW H.B. 3296 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3296 By: Goodman Judicial Affairs 4/25/2001 Introduced BACKGROUND AND PURPOSE Currently, if a retired judge or justice sits as a visiting judge, the retired judge's salary, compensation and expenses are paid out of money appropriated from the general revenue fund for that purpose in an amount equal to the compensation received from state and county sources. However, if a former judge or justice serves in the same capacity, the county pays a share of the salary, compensation, and expenses. This may preclude former judges from sitting as visiting judges. House Bill 3296 requires the salary, compensation, and expenses of a former judge or justice to be paid in accordance with the same provisions that apply to retired judges or justices assigned as visiting judges. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3296 amends the Government Code to require the salary of a former judge or justice while assigned as a visiting judge to be paid out of money appropriated from the general revenue fund and requires the salary of a former judge or justice while assigned as a visiting judge to be determined by pro rata for the period of time that the judge or justice actually sits as the assigned judge. EFFECTIVE DATE September 1, 2001.
