HBA-NRS H.B. 3376 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3376 By: Talton Transportation 4/27/2001 Introduced BACKGROUND AND PURPOSE Current law requires the commissioners court of a county with a population of 2.2 million or more to provide by ordinance for the licensing or granting of a permit to a person to remove or store an unlawfully stopped vehicle from an unincorporated area of the county. However, current law does not set forth provisions for the proper fine of an offense involving such an ordinance. House Bill 3376 establishes a fine for an offense under an ordinance that provides for the licensing or granting of a permit to a person to remove or store an unlawfully stopped vehicle from an unincorporated area of a county with a population of 2.2 million or more. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3376 amends the Transportation Code to require a person convicted of an offense under an ordinance regarding the licensing or granting of a permit to a person to remove or store an unlawfully stopped vehicle from an unincorporated area of a county with a population of 2.2 million or more to be punished by a fine of not less than $200 and not more than $500. The bill provides that a person commits a separate offense for each day the person acts in violation of such an ordinance. EFFECTIVE DATE 91st day after adjournment.
