BACKGROUND AND PURPOSE 

Currently, a municipality or county may sell a surplus building or vacant
land in a readjustment zone at less than fair market value if the governing
body of the municipality or county adheres to certain criteria.  Some local
entities may encounter difficulties while attempting to sell electrical
equipment, such as electric power poles and power lines that are located
within the readjustment zone.  The poles and lines could be construed as a
public utility and therefore would require voter approval for such a sale.
House Bill 3387 authorizes after an area is designated as a readjustment
zone the sale of any structure by a state, municipality, or county without
the imposition of election or voter approval requirements. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3387 amends the Government Code to include any structure that a
state, municipality, or county owns among property which may be disposed of
by sale after an area is designated as a readjustment zone. The bill
provides that a surplus building or vacant land may be sold without
complying with notice or bidding requirements, including election or voter
approval requirements imposed by law if certain criteria have been
satisfied. 

EFFECTIVE DATE

September 1, 2001.
