HBA-TBM H.B. 3434 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3434 By: Merritt Pensions & Investments 4/1/2001 Introduced BACKGROUND AND PURPOSE Currently, the Judicial Retirement System of Texas Plan One (retirement system) provides retirement benefits for persons who were judges, justices, and commissioners of the supreme court, the court of criminal appeals, courts of appeals, and district court, or a commission to one of those courts. Under current law, a member contributes to the retirement system at the same rate that a member of the elected class contributes to the Employees Retirement System of Texas. However, a member does not accrue additional retirement benefits beyond 20 years of accumulated service despite continuing to make contributions. House Bill 3434 provides that a member of the retirement system ceases to make contributions to the retirement system after accruing 20 years of service. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3434 amends the Government Code to provide that a member in the Judicial Retirement System of Texas Plan One ceases making contributions to the retirement system once the member accrues 20 years of service credit. EFFECTIVE DATE September 1, 2001.
