HBA-DMH H.B. 3465 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3465 By: Maxey Public Health 4/12/2001 Introduced BACKGROUND AND PURPOSE The Texas Board of Health (board) sets fees, not to exceed a maximum amount established under current law, for obtaining and maintaining registration under the Opticians' Registry Act (Act). With the growing number of voluntary registrants the specified fee amounts are not sufficient to absorb the cost of administering the Act. House Bill 3465 requires the board to prescribe by rule the fees in amounts sufficient to cover the costs of administering the Act. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Board of Health in SECTION 1 (Section 352.054, Occupations Code) of this bill. ANALYSIS House Bill 3465 amends the Occupations Code to require the Texas Board of Health (board) to prescribe by rule, not later than January 1, 2002, fees for application and issuance of registration in reasonable amounts sufficient to cover the costs of administering the Opticians' Registry Act. The bill removes the specified maximum fee amounts. EFFECTIVE DATE September 1, 2001.
