HBA-BSM H.B. 3635 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3635 By: Cook Natural Resources 3/30/2001 Introduced BACKGROUND AND PURPOSE Currently, the Wharton County Commissioners Court perform the duties for promoting improved drainage and flood control in Wharton County. An ongoing program of improved drainage and flood control is important as the population of the county grows. House Bill 3635 establishes the Wharton County Drainage District, giving the commissioners court the powers and duties of a drainage district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3635 creates the Wharton County Drainage District (district) subject to approval at a confirmation election. H.B. 3635 provides that the district is to be governed by a board of five directors, consisting of the commissioners court of Wharton County. The board of directors is required to call and hold an election to confirm the creation of the district. EFFECTIVE DATE September 1, 2001.
