BACKGROUND AND PURPOSE 

According to the 2000 federal census, Montgomery County's population
increased 61.2 percent from a decade ago.  In eastern Montgomery County,
where most of the growth has occurred, an economic development plan has
been established to help improve the quality of life for residents residing
in that portion of the county.  A major component of the development plan
is the creation of a municipal utility district (MUD) to improve the
quality of water delivery in the county and help the county address
critical water needs resulting from rapid population growth.  House Bill
3648 creates the East Montgomery Municipal Utility District No. 3 in
Montgomery County. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3648 creates the East Montgomery County Municipal Utility
District No. 3 (district) and sets forth the boundaries for the district.
The bill sets forth the rights, powers, privileges, authority, functions,
and duties of the district.   

The bill provides that the district  is governed by a board of five
directors and sets forth  provisions regarding the appointment of temporary
directors and the qualifications, terms, and election of board members.
The bill provides for a confirmation and initial directors' election and
provides that if the creation of the district is not confirmed at a
confirmation election before September 1, 2004, the Act expires on that
date. 

EFFECTIVE DATE

September 1, 2001.
