BACKGROUND AND PURPOSE 

Currently, the Port of Corpus Christi Authority owns and operates
facilities in San Patricio County and Nueces County.  C.S.H.B. 3681 offers
voters of San Patricio County the opportunity to be annexed into the Port
of Corpus Christi Authority and to have representation on the port
commission. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.H.B. 3681 requires the Commissioners Court of San Patricio County to
call and hold an election in San Patricio County to allow voting for or
against the annexation of San Patricio County to the Port of Corpus Christi
Authority (authority).  The bill sets forth provisions for the conduct of
the election. If annexation is approved, the port commission of the
authority is required to enter and have recorded an order of annexation,
and the territory annexed is subject to bonded indebtedness and taxation.   

The bill provides that if the annexation of San Patricio County is not
approved at an election held under the provisions of the bill before
September 1, 2003, the Act expires on that date. 

The bill sets forth procedures for the restructuring of the port commission
of the authority if the annexation is approved.  

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001. 

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 3681 modifies the original bill by requiring that one of the four
members appointed to the port commission of the Port of Corpus Christi
Authority by the Commissioners Court of Nueces County be a resident of Port
Aransas.
