HBA-TBM H.B. 495 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 495 By: Smith County Affairs 3/5/2001 Introduced BACKGROUND AND PURPOSE The term "antique vehicle" is referenced in various sections of the Transportation Code, but the definition of the term is not the same for each reference. To make the definition of antique vehicles uniform, and to protect all vehicles qualified as such from procedures adopted by counties and municipalities for the removal of junked vehicles, there is a need to standardize the age at which a vehicle qualifies as an antique vehicle. House Bill 495 defines an antique vehicle as a vehicle that is at least 25 years old. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 495 amends the Transportation Code to define "antique vehicle" as a passenger car or truck that is at least 25 years old rather than 35 years old. Antique vehicles are not subject to the public nuisance abatement procedures that apply to junked vehicles. EFFECTIVE DATE September 1, 2001.
