H.B. 521 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 521 By: Gallego County Affairs 3/4/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Current law authorizes the board of directors of the Maverick County Hospital District to donate surplus personal property or equipment to another governmental entity or to any charitable organization. C.S.H.B. 521 authorizes the board to donate any surplus personal property or equipment if the donation serves a public purpose and is accompanied by adequate consideration. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 521 amends law to authorize the board of directors of the Maverick County Hospital District to donate to another governmental entity or to any charitable organization any surplus personal property or equipment if the donation serves a public purpose and is accompanied by adequate consideration. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 521 removes a provision from the original bill that required the board of directors of the Maverick County Hospital District to attempt to sell surplus personal property or equipment before donating it.
