HBA-SEP H.B. 687 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 687 By: Danburg Criminal Jurisprudence 4/6/2001 Introduced BACKGROUND AND PURPOSE Under current law, a person commits a Class C misdemeanor if the person engages in deviate sexual intercourse with another individual of the same sex. Several Texas courts have found this law to be unconstitutional and further litigation relating to the constitutionality of this law may become costly. House Bill 687 repeals this law. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 687 amends the Penal Code to repeal law providing that it is a Class C misdemeanor to engage in deviate sexual intercourse with another individual of the same sex. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
