HBA-KDB H.B. 804 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 804 By: Junell State Affairs 3/14/2001 Introduced BACKGROUND AND PURPOSE Currently, the directors of legislative agencies may serve for an indefinite period, unlike the leadership of the legislature which can change every two years. It may promote political stability if agency leadership changes as legislative leadership changes. House Bill 804 provides that directors of legislative agencies serve two-year terms. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 804 amends the Government Code to provide that the state auditor, the director of the Legislative Budget Board, the executive director of the Texas Legislative Council, the director of the Legislative Reference Library, and the executive director of the Sunset Advisory Commission (directors) serve for a two-year period beginning January 1 of each odd-numbered year. The bill requires the legislative audit committee, the Legislative Budget Board, the Texas Legislative Council, the Legislative Library Board, and the Sunset Advisory Commission to meet after September 1 and before December 31 of each even-numbered year to either reappoint the respective directors or appoint another person to serve in those positions for the following two-year period. EFFECTIVE DATE September 1, 2001.
