HBA-CMT H.B. 83 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 83 By: Gallego County Affairs 7/19/2001 Enrolled BACKGROUND AND PURPOSE Under previous law, the Big Bend Regional Hospital District Board of Directors was not expressly authorized to sell, lease, or otherwise dispose of property, facilities, or equipment on behalf of the district. House Bill 83 authorizes the board to sell or otherwise dispose of property, facilities, or equipment. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 83 amends law to authorize the Big Bend Regional Hospital District Board of Directors (board) to sell, lease, or otherwise dispose of district property, facilities, or equipment. The bill provides that the sale or other disposal of the property, facilities, or equipment must be at a public sale and at a price and on the terms the board determines are most advantageous to the Big Bend Regional Hospital District (district). The bill authorizes the board to donate any surplus personal property or equipment to another governmental entity or to a charitable organization if the donation serves a public purpose and is accompanied by adequate consideration. EFFECTIVE DATE June 14, 2001.
