BACKGROUND AND PURPOSE 

Under current law, the Big Bend Regional Hospital District Board of
Directors is not expressly authorized to sell, lease, or otherwise dispose
of property, facilities, or equipment on behalf of the district.  C.S.H.B.
83 authorizes the board to sell or otherwise dispose of property,
facilities, or equipment.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.   

ANALYSIS

C.S.H.B. 83 amends law to authorize the Big Bend Regional Hospital District
Board of Directors (board) to sell, lease, or otherwise dispose of district
property, facilities, or equipment.  The bill provides that the sale or
other disposal of the property, facilities, or equipment must be at a
public sale and at a price and on the terms the board determines are most
advantageous to the Big Bend Regional Hospital District (district).  The
bill authorizes the board to donate any surplus personal property or
equipment to another governmental entity or to a charitable organization if
the donation serves a public purpose and is accompanied by adequate
consideration. 

EFFECTIVE DATE

On passage, or if the Act does not receive the required vote, the Act takes
effect September 1, 2001.  

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 83 modifies the original by adding that the Big Bend Regional
Hospital District Board of Directors (board) can lease property, equipment,
or facilities on behalf of the Big Bend Regional Hospital District
(district).  The substitute provides that any sale or other disposal of
equipment, property, or facilities must be done at a public sale and at a
price the board determines to be most advantageous to the district.  The
substitute differs from the original by authorizing the board to donate
surplus personal property and equipment to another governmental entity or
charitable organization.
