HBA-SEP H.B. 850 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 850 By: Williams Criminal Jurisprudence 4/12/2001 Introduced BACKGROUND AND PURPOSE Current law provides that it is a Class A misdemeanor to intentionally or knowingly make a false or misleading written statement to obtain property or credit regardless of the property's value or credit amount. It may be more appropriate to structure penalty levels in relation to property value or credit amounts. House Bill 850 establishes such penalty levels. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 850 amends the Penal Code to establish penalty levels in relation to property value or credit amounts for the offense of making a false statement to obtain property or credit. EFFECTIVE DATE September 1, 2001.
