HBA-BSM H.B. 958 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 958 By: Burnam Land & Resource Management 7/26/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, municipalities were not required to annex a county road when they annexed an area of land that is adjacent to the road. As well, municipalities sometimes annexed only to the centerline of the road. This can result in confusion and conflict in jurisdiction and responsibility for these roads. House Bill 958 provides that municipalities must annex the entire width of a paved county road and the adjacent right-of-way if the municipality annexes any portion of the road. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 958 amends the Local Government Code to provide that a municipality that proposes to annex any portion of a paved county road must also annex the entire width of the county road and the adjacent right-of-way. The bill sets forth provisions regarding the applicability and implementation of these provisions to a municipality's annexation plan. EFFECTIVE DATE September 1, 2001.
