HBA-BSM, CBW H.B. 958 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 958 By: Burnam Land & Resource Management 2/14/2001 Introduced BACKGROUND AND PURPOSE Under current law, municipalities are not required to annex a county road when they annex an area of land that is adjacent to the road. This can result in confusion and conflict in jurisdiction and responsibility for these roads. House Bill 958 provides that municipalities must annex a county road if the road is adjacent to an area annexed by the municipality. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 958 amends the Local Government Code to provide that a municipality must annex a county road, including the right-of-way on each side of the road, if the road is adjacent to an area proposed to be annexed by the municipality. The bill sets forth provisions regarding the applicability and implementation of these provisions to a municipality's annexation plan. EFFECTIVE DATE September 1, 2001.
