HBA-JLV H.B. 9 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 9 By: Truitt Land & Resource Management 4/2/2001 Introduced BACKGROUND AND PURPOSE Current law prohibits local governments that are not constituent agencies of an airport board jointly owned by two populous municipalities from enacting or enforcing zoning ordinances, subdivision regulations, construction codes or other ordinances purporting to regulate the use or development of any property within the boundaries of such an airport. House Bill 9 authorizes such cities whose corporate limits include property owned by an airport to enact local zoning ordinances applicable to nonessential property located within the boundaries of the airport. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 9 amends the Transportation Code to provide that the prohibition on the enactment of local zoning ordinances by cities which have corporate limits that include property owned by an airport is only applicable to essential airport property located within the boundaries of the airport. EFFECTIVE DATE September 1, 2001.
