HBA-DMH H.C.R. 218 77(R) BILL ANALYSIS Office of House Bill AnalysisH.C.R. 218 By: Burnam Civil Practices 4/9/2001 Introduced BACKGROUND AND PURPOSE Matthew Carroll alleges that he was employed with Texas A&M University's Center for Housing and Urban Development as project manager for the Progreso Family Community Center Project and the he was wrongfully discharged by Texas A&M University. Mr. Carroll alleges that the termination resulted from his refusal to falsify time sheets in violation of the Federal Fair Labor Standards Act of 1938 relating to the keeping of wage and hour records. Mr. Carroll alleges that he is entitled to recover damages and other relief as the court deems appropriate. House Concurrent Resolution 218 grants Matthew Carroll permission to sue the State of Texas and The Texas A&M University System. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Concurrent Resolution 218 grants Matthew Carroll permission to sue the State of Texas and The Texas A&M University System and provides that the chancellor of The Texas A&M University System be served a citation and other required process.
