HBA-JEK H.J.R. 110 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 110 By: Homer Licensing & Administrative Procedures 3/30/2001 Introduced BACKGROUND AND PURPOSE The growth of the Texas wine industry continues to have a positive effect on the state's economy. Removing local restrictions on the dispensing of wine would lead to increased tourism and a greater economic benefit for the state. As proposed, House Joint Resolution 110 requires the submission to the voters of a constitutional amendment to grant the right to sell and serve Texas wine on a winery premises. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 110 amends the Texas Constitution to authorize the holder of a winery permit to sell, serve, or dispense free Texas-made wine for consumption on the winery premises regardless of whether the winery is located in an area in which a local restriction or prohibition on the possession or sale of intoxicating liquors applies. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
