HBA-MPM H.J.R. 1 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 1 By: McCall Pensions & Investments 2/28/2001 Introduced BACKGROUND AND PURPOSE The Sunset Advisory Commission's report to the 77th Legislature noted that the fire fighters' pension commissioner is currently appointed by the governor for a two-year term, and proposed that lengthening the commissioner's term from two to four years would improve the link and accountability between the commissioner and the governor making the appointment. Because the Texas Constitution provides that gubernatorial appointments are two years, the proposal requires a constitutional amendment. House Joint Resolution 1 sets forth that if the legislature provides for a fire fighters' pension commissioner, the commissioner's term of office is four years if approved by the voters. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 1 specifies that if the legislature provides for a fire fighters' pension commissioner, the commissioner's term of office is four years. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
