HBA-DMH H.J.R. 43 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 43 By: Wilson Licensing & Administrative Procedures 3/26/2001 Introduced BACKGROUND AND PURPOSE Currently, New Jersey, Nevada, Minnesota, Mississippi, and Louisiana have taxed casino gambling. These casinos have provided over 50 thousand jobs, reduced taxpayers' welfare payments by $50 million per year, and generated $120 million annually in state and local taxes. As proposed, House Joint Resolution 43 requires the submission to the voters of a constitutional amendment authorizing the legislature to authorize the state to operate casinos and games of chance or skill at a state-operated casino. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 43 amends the Texas Constitution to provide that the legislature by general law may authorize the state to operate casinos and games of chance or skill at a state-operated casino. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
