HBA-DMH H.J.R. 89 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 89 By: Eiland County Affairs 4/16/2001 Introduced BACKGROUND AND PURPOSE An attorney general opinion concluded that the commissioners court of a county does not have the authority to use county funds for road repairs or improvements. As proposed, House Joint Resolution 89 requires the submission to the voters of a constitutional amendment authorizing a county to use any available funds to construct, maintain, or improve in the county any street, road, or highway of a city, town, or village. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 89 amends the Texas Constitution to authorize a county to use any available funds, including funds derived from bonds or other debt authorized by Section 52, Article III, Texas Constitution, to construct, maintain, or improve in the county any street, road, or highway of a city, town, or village. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
