HBA-MSH S.B. 104 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 104 By: Van de Putte Public Education 4/23/2001 Engrossed BACKGROUND AND PURPOSE Under current law, the State Board for Educator Certification (SBEC) identifies the continuing education courses and programs that fulfill the continuing education requirements for educators. SBEC rules sets forth a list of authorized subjects for continuing education such as discipline management, increasing and maintaining parental involvement, and integration of technology into educational practices. There is no requirement for a course on the detection of child abuse and neglect. Senate Bill 104 requires educators to receive one hour of continuing education on the detection of child abuse and neglect. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 104 amends the Education Code to require the State Board for Educator Certification to require that teachers complete at least one hour of training in the detection of child abuse and neglect as part of the requirements for certification renewal. The bill authorizes the training to be provided by videotape or distance learning. EFFECTIVE DATE September 1, 2001.
