HBA-BSM S.B. 1094 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1094 By: Nelson Judicial Affairs 4/29/2001 Engrossed BACKGROUND AND PURPOSE Under current law, Denton County statutory probate court sits in the county seat or at another assigned location and the statutory probate court is authorized to conduct docket matters at other locations in the county as determined necessary for the protection of ward or mental health respondents. However, Denton County may be aided if the docket balance is more evenly distributed among statutory and probate courts. Senate Bill 1094 repeals law regarding the exclusive jurisdiction of the County Court at Law No. 1 of Denton County over Class C misdemeanor appeals and the prohibition against a judge of a county criminal court being assigned as a visiting judge to certain counties. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1094 amends the Government Code to repeal the exclusive jurisdiction of the County Court at Law No. 1 of Denton County over Class C misdemeanor appeals from inferior courts and the prohibition against a judge of a county criminal court in Denton County being assigned as a visiting judge to certain counties. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
