HBA-CBW S.B. 1178 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1178 By: Gallegos Public Education 4/30/2001 Engrossed BACKGROUND AND PURPOSE Under current law, exemptions to open meeting requirements allow closed deliberations on the filling of a vacancy on the board of trustees of an independent school district. Senate Bill 1178 removes the exemption for independent school districts that have an enrollment of at least 195,000 students. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1178 amends the Government Code to provide that exemptions to open meeting requirements for a governmental body deliberating certain personnel matters do not apply to a deliberation by the board of trustees of an independent school district that has an enrollment of at least 195,000 students if the board is deliberating the appointment of a trustee to fill a vacancy on the board of trustees. The Act applies only to a meeting of a school district board of trustees that initially convenes on or after September 15, 2001. EFFECTIVE DATE September 1, 2001.
