HBA-MSH S.B. 1213 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1213 By: Zaffirini Public Safety 5/6/2001 Engrossed BACKGROUND AND PURPOSE The Department of Public Safety (DPS) believes that a vertical driver's license would be more effective in preventing underage drinking than current driver's licenses that show the person in profile. Senate Bill 1213 removes the requirement that provisional licenses issued to minors under 18 years of age show the photo of the person in profile and requires DPS to orient information on licenses issued to persons under the age of 21 so that the license can be clearly distinguished. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1213 amends the Transportation Code to remove the requirement that a provisional driver's license include a color photograph of the profile of the holder of the license. For each original, renewed, or duplicate license issued to a person who is under 21 years of age the bill requires the Department of Public Safety to orient the information on the license to clearly distinguish the license from a license that is issued to a person who is 21 years of age or older. EFFECTIVE DATE September 1, 2001.
